Montana Park- Dogs

Our PCSOs have received a complaint regarding loose uncontrolled dogs in Montana Park. We kindly request owners keep their dogs on leads so we can all enjoy the space and look after our animals and children.

There is no blanket nationwide law requiring dogs to be on leads at all times in all public spaces. However, strict lead laws apply in specific locations, situations, and for certain breeds to ensure safety and compliance with UK legislation.

Where Dogs MUST Be Kept on Leads

Roads and Pavements: Under the Road Traffic Act 1988, dogs must be held on a lead on designated roads. The Highway Code (Rule 56) also advises keeping dogs on a short lead when walking on roads or paths shared with riders or cyclists.

Around Livestock: The Countryside Code requires dogs to be on a lead in areas with livestock. The Dogs (Protection of Livestock) (Amendment) Act strengthens this, allowing unlimited fines and broader police powers if a dog worries (chases or causes distress to) livestock. This applies to footpaths crossing fields as well.

Local Public Spaces: Under Public Spaces Protection Orders (PSPOs), local councils legally require dogs to be on leads in specific areas such as children’s play areas, sports pitches, beaches, and certain parks. Look out for local signage. Failing to comply can result in a Fixed Penalty Notice of up to £100, or a fine of up to £1,000 if prosecuted.

Specific Breeds: Banned or exempted breeds, such as the XL Bully, must be muzzled and kept on a lead at all times in public by law.

General "Under Control" Law

If your dog is off-lead, it must remain in sight and close enough to return immediately on command. It must also not approach other people or dogs uninvited.

Even in areas where you are legally permitted to let your dog off-lead, they must remain under "close control". If a dog is dangerously out of control—meaning it injures someone or makes someone fear they may be injured—owners can face unlimited fines or up to 5 years in prison.
